Terms and Conditions

  1. Sale of goods
    If you place an order for any goods from this website, this shall be deemed to be conclusive evidence of your acceptance of these terms and conditions.
    You must ensure that any orders made via this website are complete and accurate.
    No contract will come into existence until you receive an acknowledgement of your order via e-mail.

  2. Description of goods
    All drawings, descriptive matter, specifications, advertising, descriptions or illustrations in this website are published for the sole purpose of giving an approximate idea of the goods described in them. They do not form part of any contract.
    Brookside Products Limited reserve the right to swap any goods ordered for a similar alternative in circumstances where the goods are unavailable at the time of dispatch. However, we will contact you before dispatch to discuss any alterations, which are to be made.

  3. Delivery
    You will be sent an email on the day before your goods are despatched to confirm the date on which they will be delivered. It is your own responsibility to ensure that someone is present at the delivery address in order to take delivery of the goods.
    Any times specified by Brookside Products Limited for delivery of goods ordered from this website are approximate only and may not be made of the essence by notice. If no dates are so specified, delivery will be within a reasonable time.
    Subject to the other provisions of these terms and conditions Brookside Products Limited will not be liable for any loss (including loss of profit) costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the goods.
    If you fail to take delivery of any of the goods, the goods will be deemed to have been delivered and (without prejudice to its other rights) Brookside Products Limited may:

    • store or arrange for the storage of the goods until actual delivery or sale and charge you for all related costs and expenses (including, without limitation, storage and wastage); and/or
    • following written notice to you, sell any of the goods at the best price reasonably obtainable in the circumstances and charge you for any shortfall below the price stated on the website at the time of your purchase.


  4. Risk/ownership
    Risk of damage to or loss of goods shall pass to you upon the goods being despatched.
    Ownership of any goods ordered from this website shall pass to you upon the goods being despatched.

  5. Price
    The price of any goods advertised on this website shall be the price stated subject to the conditions below. We update the prices set out on this website on a regular basis. However, owing to the nature of the goods, prices may differ slightly in accordance with their daily market value.
    Therefore, we reserve the right to alter any prices stated on this website in accordance with the above.

  6. Quality
    Brookside Products Limited warrants that (subject to the other provisions of these terms and conditions) upon delivery, the goods will be of satisfactory quality within the meaning of the Sale of Goods Act 1994.
    However, whilst we make every effort to ensure that any frozen items remain frozen on delivery, we cannot be held responsible for any defrosting which may occur in transit.

  7. Payment
    Payment must be made at the time of placing your order and we will not issue an acknowledgement of the receipt of your order via email until payment has been made.

  8. Limitation of liability
    All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are excluded from any orders made using this website.
    Nothing in these terms and conditions excludes or limits the liability of Brookside Products Limited for death or personal injury caused by our negligence or fraudulent misrepresentation.

  9. Force Majeure
    Brookside Products Limited shall not be liable in any manner, or be deemed to be in breach of any contract arising, because of any delay in performing or any failure to perform any of its obligations if the delay or failure was due to any cause beyond Brookside Products Limited’s reasonable control.

  10. Cancellation
    You may contact us to cancel or amend your order within 24 hours of placing your order. However, where goods have been despatched within this period, your right to cancel or amend your order will end at the time of despatch. Brookside Products Limited reserve the right to decline any orders placed via this website.

  11. Returns
    Please note, we cannot accept the return of any perishable goods purchased via this website unless they are unfit for consumption at the time at which they are delivered.

  12. General
    These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. If any of these Terms and Conditions is held by any court of a competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
